Chapter 7 Bankruptcy
Chapter 7 Bankruptcy eliminates all credit card debt and debts from doctor and/or medical bills.
As of 2005, you are not allowed to file a Chapter 7 petition if your income is too high compared to your reasonable living expenses, so this is not for everyone. Also, a Chapter 7 filing will not save your house from foreclosure or your car from repossession.
Chapter 13 Bankruptcy
Chapter 13 Bankruptcy is generally for people who are behind on their house and/or car payments because of high credit card, doctor, and/or medical bills.
In order to save your house, you make your normal monthly payments, plus monthly payments to the court to make up any past due amounts. The payment plan will be between three and five years. At the end of the repayment period, you no longer have to pay for any remaining unsecured debt (such as credit cards, doctor, and medical bills).
In order to save your car, you begin making monthly payments to the court that cover your normal payments and your past due amount.
By law, all actions against a debtor, such as lawsuits, wage garnishment, and harassing phone calls demanding payment must stop once the Bankruptcy documents are filed with the Trustee.
